He was a member of the Joint Ministerial Committee that drafted the final wording of the new Brazilian Bankruptcy Law.

Ivo Waisberg is a lawyer with Wald Associados Advogados. JSD in International Economic Relations Law and LLM in Commercial Law at the Pontifícia Universidade Católica de São Paulo. LLM in Trade Regulation at the New York University School of Law. Teacher-Author of the On-line Banking Law Course of FGV-RJ. Invited teacher at the GV-Law specialization course of Corporate Law and Teacher of Financial and Capital Market Law and Stock Market of LLM Course at IBMEC-SP. Author of Civil Responsibility of Commercial Bank Managers' (Revista dos Tribunais, 2002) and Law and Competition Policy For Development Countries (Lex Editora, 2006). Organizer of the book Banking Agreements, (Quartier Latin, 2006), in addition to other law articles. Acted as legal advisor of VASP and Laginha Agroindustrial in the approval of the in-court turnaround plan. Acted as legal advisor of major financial institutions on judicial restructuring procedures, such as, Agrenco and Selecta’s procedures. Acted as legal advisor of major companies on debt restructuring procedures (out of court), such as Aracruz Celulose’s renegotiation of derivatives.

Salvatore has experience at Bayerische Private Bankers, as credit analyst, working with the team of Emerging Markets, and at Duff & Phelps Credit Rating Co., as rating analyst. He worked at Banca Commerciale Italiana (currently Intesa Sanpaolo), participating in various projects of restructuring and acquisition in the European Union, in East Europe and Latin America. Since May 2002 he has been working full time in the Restructuring department at KPMG in Brazil, leading various financial and operational restructuring processes, crisis management processes to cash management in a financial crisis situation, planning and implementation of turnarounds, restructuring processes in judicial and extrajudicial recovery procedures, renegotiation of debts for the management of communication processes with financial/operational creditors and unions, fund raising and sale of assets. Salvatore has also been leading transactions and solutions for “defaulted credit portfolios” (NPLs – Non Performing Loans).

André Schwartzman has occupied executive-level positions in mid and large-size public and private companies, with experience in turnaround and new business start-ups. Has Served as Controller of Infinity Bio-Energy S/A, witch is an AIM- and CVM/Bovespa-listed Brazilian company that produces renewable fuels, with an emphasis on ethanol made from sugarcane (US$ 170 million sales revenue). He had been Controller and Executive in charge of Planning and Business Management of Parmalat Brasil S/A, a CVM/Bovespa-listed food and beverage company (US$ 500 million sales revenue), in witch he had an active role in its recovery process. Acted as Chief Financial Officer in healthcare and retails companies in Brazil. As consultant, has developed projects at a number of companies, with a focus on auto parts and retail industries. Since October 2008 he has been working as Director in Restructuring department at KPMG Brazil, leading various projects in court-driven restructuring, operational and financial restructuring, crisis cash management, and profit improvement programas. He is the leader of the Totaal Cash and Working Capital practice in Brazil, a global KPMG methodology aimed at improving the management of cash and related assets and liabilities in an efficient and cost effective basis in order to optimize liquidity and improve profitability.

fabio-rosasFabio Rosas, partner in the Litigation, Tax Law and Debt Restructuring and Workouts practice groups of Tozzini Freire Advogados. Graduated from the Law School of Pontifícia Universidade Católica de São Paulo (PUC-SP) in 1993 and studied at the Academy of American and International Law, organized by the Center for American and International Law, in Dallas, Texas, USA, in 2007. Fábio is member of the Brazilian Bar Association, Federal District (2003) and São Paulo State (1993) sections, the Association of Lawyers of São Paulo (AASP), the Brazilian Center of Judicial Studies and Research (CEBEPEJ), the International Association of Restructuring, Insolvency & Bankruptcy Professionals (INSOL) and the International Institute of Insolvency. Vander Giordano is the director of Intelligence and Development of Kroll in Latin America. He has been working more than ten years executing and supervising projects to reduce corporative risks. He is expert in several kinds of issues as: fraud identification and prevention, assets recovery, litigation support, “due diligence”, IP protection, investigation of disloyal competition and fiscal problems, large sectors’ experience in Energy, Aeronautical, Banking, Retail and Steel sectors.
